1. Acceptance of These Terms

These Terms of Service ("Terms") are an agreement between you and Horix Technologies Limited ("we," "us," or "our") governing your use of Tricky Puzzle Party (the "App").

By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

These Terms apply together with our Privacy Policy, which explains how information is collected and used.

2. Eligibility

You may use the App only if you can form a binding agreement with us or have permission from a parent or legal guardian who agrees to these Terms on your behalf.

If you are a parent or guardian, you are responsible for your child's use of the App, including any purchases made on the device.

3. License to Use the App

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the App on Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.

This license does not transfer ownership of the App or any of its content to you.

4. Restrictions

You agree not to:

• Copy, modify, distribute, sell, rent, or sublicense the App or its content.
• Reverse engineer, decompile, or attempt to extract the source code of the App, except where permitted by law.
• Remove or alter any copyright, trademark, or other proprietary notices.
• Interfere with, disrupt, or attempt to bypass the App's security, advertising, or purchase verification features.
• Use cheats, automation, bots, or exploits that affect the App or other users.
• Use the App for any unlawful, harmful, or fraudulent purpose.

5. Games and Third-Party Content

The App gives access to a collection of mini-games. Some games and related content may be provided by third-party developers or publishers.

Game availability may change over time. We may add, update, or remove games without notice.

Third-party content remains the property of its respective owners and may be subject to their own terms.

6. Advertising

The App is supported by advertising. Advertisements may be displayed before, during, or between gameplay, including rewarded advertisements that you may choose to watch.

Advertisements are provided by third-party advertising partners. We are not responsible for the content of third-party advertisements or for products or services offered by advertisers.

Information processed for advertising is described in our Privacy Policy.

7. Remove Ads Lifetime Purchase

The App offers an optional one-time in-app purchase called "Remove Ads Lifetime."

• It is a non-consumable purchase. It is not a subscription and does not renew.
• After successful purchase verification, advertisements within the App are disabled for your Apple Account.
• Rewarded features that you choose to activate may continue to work as offered in the App.
• You can restore the purchase on devices signed in with the same Apple Account by using the restore option in the App.

All payments are processed by Apple through the App Store. Prices are shown in the App Store before purchase and may vary by region.

Refund requests are handled by Apple under Apple's policies. We cannot issue refunds directly for purchases made through the App Store.

8. Intellectual Property

The App, including its design, logos, artwork, characters, text, software, and other content, is owned by us or our licensors and is protected by intellectual property laws.

"Tricky Puzzle Party" and related names and logos may not be used without our prior written permission.

9. Updates and Availability

We may update, modify, suspend, or discontinue the App or any part of it at any time.

Some updates may be required to continue using the App.

Many games require an internet connection. We do not guarantee that the App or any game will always be available, uninterrupted, or error-free.

10. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Nothing in these Terms excludes warranties that cannot be excluded under applicable law.

11. Limitation of Liability

To the maximum extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of the App.

To the extent liability cannot be excluded, our total liability is limited to the amount you paid for the App and in-app purchases during the twelve (12) months before the claim.

Nothing in these Terms limits liability that cannot be limited under applicable law, including mandatory consumer protection rights.

12. Termination

These Terms remain in effect until terminated.

Your rights under these Terms end automatically if you fail to comply with them. You may stop using the App and delete it at any time.

Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, and limitation of liability.

13. Apple App Store Terms

You and we acknowledge that:

• These Terms are between you and Horix Technologies Limited only, not with Apple Inc. ("Apple"). We, not Apple, are solely responsible for the App and its content.
• Apple has no obligation to provide any maintenance or support services for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the App. To the maximum extent permitted by law, Apple has no other warranty obligation regarding the App.
• We, not Apple, are responsible for addressing any claims relating to the App or your use of it, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and consumer protection claims.
• In the event of a third-party claim that the App or your use of it infringes that third party's intellectual property rights, we, not Apple, are responsible for the investigation, defense, settlement, and discharge of that claim.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• You must comply with applicable third-party terms when using the App.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

14. Changes to These Terms

We may update these Terms from time to time.

Updates will be indicated by revising the "Last Updated" date. Where legally required, we will provide additional notice.

Continuing to use the App after the updated Terms take effect means you accept them.

15. Governing Law

These Terms are governed by the laws of the jurisdiction in which Horix Technologies Limited is registered, without regard to conflict of law rules.

If you are a consumer, you also keep the protection of the mandatory laws of your country of residence.
